Welcome to Fluffy's Hibachi. These Terms and Conditions ("Terms") govern your use of our mobile hibachi services and website. By booking our services or using our website, you agree to these Terms.
1. Service Agreement
When you book Fluffy's Hibachi services, you enter into a service agreement with us. We agree to provide mobile hibachi catering services as described in your booking confirmation, and you agree to pay the agreed-upon fees.
2. Booking and Payment
Reservation Requirements
- Minimum order requirement: $550
- Advance booking required (minimum 48 hours notice)
- Valid contact information must be provided
- Service location must be within our service areas
Payment Terms
- A deposit may be required to secure your booking
- Full payment is due upon completion of service unless otherwise agreed
- 18% gratuity automatically added for parties of 8 or more
- We accept major credit cards and other approved payment methods
3. Cancellation and Refund Policy
Cancellation by Customer
- 48+ hours before event: Full refund of deposit
- 24–48 hours before event: 50% of deposit retained
- Less than 24 hours before event: Full deposit forfeited
Cancellation by Fluffy's Hibachi
In the rare event we must cancel due to circumstances beyond our control (e.g., severe weather, illness), we will provide a full refund or reschedule at your convenience.
4. Service Execution
What We Provide
- Professional hibachi chef(s) and servers
- Hibachi grill equipment and setup
- All cooking utensils and service items
- Fresh ingredients as per menu selection
- Entertainment and cooking demonstration
- Setup and cleanup of our equipment
Customer Responsibilities
- Provide adequate space for setup (minimum 10x10 feet)
- Ensure a level, stable surface for the grill
- Provide access to electrical outlets if needed
- Provide tables and seating for guests
- Ensure guests are ready at the scheduled service time
- Supervise children and maintain safe distance from cooking area
5. Food Safety and Allergies
We follow all applicable food safety regulations. Please inform us of any food allergies or dietary restrictions at booking. While we make reasonable efforts, we cannot guarantee that food is allergen-free due to the nature of our cooking process.
6. Liability and Indemnification
Limitation of Liability
Fluffy's Hibachi shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid for services.
Indemnification
You agree to indemnify and hold harmless Fluffy's Hibachi, its owners, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
7. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Fluffy's Hibachi and protected by copyright law. You may not use our intellectual property without express written permission.
8. Photography and Marketing
We may take photos or videos during service for marketing. By booking, you grant us permission to use these materials unless you notify us otherwise at the time of service.
9. SMS Text Messaging Terms
Consent to Receive SMS Messages
By checking the SMS consent box during booking and providing your mobile phone number, you expressly consent to receive transactional SMS text messages from Fluffy's Hibachi related to your reservation. These messages include:
- Booking confirmations
- Scheduling updates or changes
- Chef arrival notifications
- Service reminders
- Important updates about your event
Message Frequency
You will receive approximately 2-5 SMS messages per booking. Message frequency may vary based on your specific booking needs and any changes to your reservation.
Message and Data Rates
Standard message and data rates may apply according to your mobile phone service plan. Please contact your mobile service provider for details about your plan.
Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any message. Upon receipt of your STOP message, we will send you a one-time confirmation message and will not send you any further SMS messages unless you re-opt in.

Privacy and Data Use
- Your mobile phone number and opt-in data will not be shared with third parties for marketing purposes.
- We will only use your mobile number for transactional messages related to your Fluffy's Hibachi booking.
- All SMS opt-in data and consent records are securely stored and protected.
- Carriers are not liable for delayed or undelivered messages.
Supported Carriers
Our SMS service is compatible with major US carriers including but not limited to: AT&T, Verizon, T-Mobile, Sprint, Metro PCS, US Cellular, and others. T-Mobile is not liable for delayed or undelivered messages.
10. Governing Law
These Terms shall be governed by the laws of the State of Florida. Any disputes shall be resolved in Florida courts.
11. Modifications to Terms
We may update these Terms at any time. Updated Terms will be posted on our website with the revised effective date. Continued use of our services after updates constitutes acceptance.
